Welcome to M-Jobo, a job matching service provided by Samala Limited, its subsidiaries and affiliates (herein referred to as "Samala", "we" "our", or "us" which may be used interchangeably unless the same is repugnant or contrary to the Context).

These Terms of Use  govern your use of the M-Jobo platform consisting of apps (herein referred to as the "App"/ "Apps") , USSD Code and its associated tools, features, applications, data, software and other services provided in association of the App ( herein referred to as the "Services"/ "Platform", used interchangeably unless the same is repugnant or contrary to the Context).

These Terms of Use, together with our Privacy Policy, all of which are incorporated by reference into these Terms of Use, constitute a legally binding contract (the "Agreement"), between you and  us in relation to your use of our Services.

Although, we may attempt to notify you when major changes are made to these Terms of Use, you should periodically review the most up-to-date version of these terms and conditions which can be accessed from within the App or on our website. It is your responsibility to check the terms and conditions on this page from time to time for updates. We may, in our sole discretion, modify or revise these Terms of Use and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in these Terms of Use shall be deemed to confer any third-party rights or benefits.

ACCEPTANCE OF TERMS OF USE:

You are deemed to have accepted these Terms of Use as amended from time to time and which take effect when you access our platforms or use any of our services.

PLATFORM

The Platform is a hosting service. Subject to all the terms, restrictions and unequivocal acceptance of the consequences mentioned herein, users of the Platform (hereinafter referred to as 'Users') may view, access, submit, upload and post a vacancy, job description, salary expectation, timelines, comments, and other job content , data or desirable specification for a particular job.("Job content "). The Job content uploaded by you on the Platform for the purposes of being viewed by other users of the Platform shall be solely at your volition and you acknowledge that you own and control all legal rights for distributing such Job content through the Platform. The Platform may also enable users to interact with one another and to contribute to discussions, and enable any user of the services to view and share Job content uploaded and made available by you.

We may, from time to time, release new tools and resources on our website, release new versions of our Apps, or introduce other services and/or features on the Platform. Any new services and features will be subject to these Terms of Use as well as any additional terms and conditions that we may release for those specific services or features.

YOUR M-JOBO ACCOUNT

Access to the Platform will only be made available to registered/ subscribed users. 

Upon registration/subscription, you agree to provide us with all the requisite details/ documents as may be requested for from time to time. You may be asked to set your unique credentials being your username and password for your account. You must ensure that the email address that you provide is, and shall always remain valid. Your email address and any other information you chose to provide about yourself will be treated in accordance with our Privacy Policy.

You are solely responsible for maintaining the confidentiality and security of your username and password and you, irrespective of the termination of this Agreement, shall always remain responsible for all use of your username and password and all activities emanating from your account, whether or not such activity was authorized by you.

If your username or password is lost or stolen or if you believe that your account has been accessed by unauthorized third parties, you are advised to notify us immediately in writing, and also change your password at the earliest possible opportunity.

We reserve the right to disallow, cancel, remove or reassign certain usernames and permalinks in appropriate circumstances, as determined by us, in our sole discretion and may, with or without prior notice, suspend or terminate your account if activities occurring through/ associated with your account, in our sole discretion, would or might constitute a violation of these Terms of Use or an infringement or violation of the rights of any third party, or of any applicable laws or regulations.

You may terminate your account at any time as described in theTermination section below.

FEE & PAYMENTS

Subscriptions to the job content available on our Platform are by using mobile phone airtime charges or through any other mode which may be made available from time to time.

Unless otherwise stated all charges include Value Added Tax but are subject to other applicable levies and taxes at the then prevailing rates

We reserve the right to change the charges for the Services and the availability of the Services in our sole discretion with or without notice.

If for any reason we do not receive complete payments from any of the payment modes, you agree that you shall pay all amounts due through deductions from your mobile phone airtime balance without us or the mobile service provider being under an obligation to obtain your consent again for such deduction. Further, you agree and provide your consent to us automatically renewing your subscription at the end of term of the erstwhile subscription without taking any further consent. However, you are free to unsubscribe/ terminate your subscription at your discretion by following the process of un-subscription intimated and/or prescribed from time to time. Provided, that if the Subscription is terminated we shall not be under any obligation to refund the subscription fee or any part thereof.

You further agree and undertake that you are accessing the Services and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction on or through the Services.  We accepts no responsibility/liability for any errors or omissions, whether on our own behalf or or third parties.

YOUR USE OF THE PLATFORM

Subject to your strict compliance with these Terms of Use you are granted limited, personal, non-exclusive, revocable, non-assignable and non-transferable right and license to access the Platform in order to view Job content  uploaded and posted on the Platform online and to share the links (conditional download) of the vacancies using the features of the Platform where the appropriate functionality has been enabled by the User who uploaded the relevant Job content  ( herein referred to as the "Uploader"). The Uploader unequivocally and irrevocably acknowledges that they completely understand that they can upload only such Job content pieces in which they have acquired approval and are aware/ accountable to the authenticity of the job content. 

The above licenses are further conditional upon the following:

1. You must not republish, make available or otherwise communicate to the public, transfer, share, use or exploit any Job content on or from the Platform at any and all times.

2. You must not employ any techniques or make use of any services, automated or otherwise, designed to misrepresent the popularity of Your Job content on the Platform, or to misrepresent your activity on the Platform.

You agree to comply with the above conditions at any and all times during your use of the Platform, and acknowledge and agree that we have the right, in our sole discretion, to terminate your account or take such other action as we see fit if you breach any of the above conditions or any of the other terms of these Terms of Use. This may include taking court action and/or reporting offending users to the relevant authorities including the police.

DISCLAIMER

The job content available on the platform is provided on an "as is", "as available", and "with all faults" basis. T It is uploaded by up loaders who are solely responsible for the legality and the authenticity of the job content made available by such up loaders on the platform. We therefore disclaim any liability or responsibility pertaining to the job content made available on the platform. The platform, and/ or services accessed through the platform, or otherwise, are provided on an "as is", "as available", and "with all faults" basis. Whilst we may use reasonable endeavors to correct any errors or omissions in the platform as soon as practicable once they have been brought to our attention, we make no promises, guarantees, representations or warranties of any kind whatsoever (express or implied) regarding the services or any part or parts thereof, any job content, or any linked services or other external services. We do not warrant that your use of the platform will be uninterrupted, timely, or error-free, that defects will be corrected, or that the platform or any part or parts thereof, the job content, or the servers on which the platform operates are or will be free of viruses or other harmful components.
